Nellcor Wins Noninfringement Judgment of Masimo Patent
The US Court of Appeals for the Federal Circuit last month affirmed the US District Court for the Central District of California decisions granting Nellcor’s motion for summary judgment of noninfringement of Masimo US Patent 6,036,642. It also denied Masimo’s related motion for a preliminary injunction. Nellcor denies Masimo’s claim that the NellcorŪ N-395 Pulse Oximeter and MP404 OEM circuit board infringe the ’642 patent. Nellcor continues its own patent infringement claim against Masimo for infringing seven patents, and in June, Nellcor filed a motion seeking a preliminary injunction prohibiting Masimo’s continued sales of its Radical product and SatShare cable.

HME Insider
photoDealer/Provider spoke with Jay Williams, QS/1’s national sales manager for HME, about the impact of the new privacy standards, the advantages of computerization, and the impact of the slowing economy.

Q How are Health Insurance Portability and Accountability Act privacy regulations and the new X12 electronic format impacting HME?
A
Providers are concerned particularly about the privacy standards that are part of the HIPAA regulations. When providers pull up a record, they have to be able to track who accessed this record, when they accessed it, and why they accessed it. That could get prohibitive to people because it could double or triple their work load.

Q How is QS/1 helping customers to be HIPAA-compliant?
A
We get calls every day at our corporate office about whether our software is compliant. It is not the software but the customer who needs to be compliant. [Our software is] going to keep up with who created [the record] and who the last person was that changed it.

Q Howhould HME providers react to the current economic slowdown?
A
The majority of HMEs get 90% to 95% of their revenue from a third-party payor, so the economic ups and downs are not so bad. If you have a sizeable portion of cash business, then that could affect you somewhat.

Q What is the advantage of QS/1’s system?
A
QS/1 helps automate the process of entering billing and payment information. The provider can track how much each company owes, do inventory control, check on purchase orders, and handle monthly rental issues. We have a package that is fast and easy to use. People want to do things quickly, but they also want to get information back out.

Q What sort of customer support do you offer?
A
We have more than 70 support technicians in 17 offices across the country and Canada, and they are available from 8 am to 10 pm Monday through Friday. Support is really important to people and probably 98% of our calls get resolved the same day. We do regional training in our offices on all our products, so in most cases it’s not real far [for people] to come. www.qs1.com;  (800) 845-7558.
